All new customers are first supplied on a pro-forma basis. To enable a credit account to be opened, a completed and signed Credit Application and Terms of Trade form will need to be received and processed prior to dispatch of goods. The offer of credit terms is dependent upon credit checks with our insurers.
1) Prices quoted are exclusive of standard rate VAT.
2) Minimum order value is £100 ex VAT. Orders placed with a net value of below £150 will require payment by credit or debit card prior to dispatch, with the exception of personalised items (Rail Name BR100 – BR128 and Star Letters BJ561-BJ586) see point 2.1
2.1) For personalised items (Rail Name BR100 – BR128 and Star Letters BJ561-BJ586) there is no minimum order. Orders under £75 have a carriage charge of £5, orders above £75 are carriage paid. If ANY other non personalised items are added then normal rules apply, see point 2
3) Carriage paid orders over £275 ( England, Wales, Scotland). Carriage paid orders over £400 (N. Ireland and Eire).
4) For all new customers, initial orders must be £275 + VAT and on pro-forma basis.
5) For orders below £275 to a mainland address a carriage charge of £8.50 will be applied. For customers in Northern Ireland and Eire, orders placed below £400, a carriage charge of £30 will be applied.
6) Back orders are kept unless otherwise requested. You will be contacted prior to the dispatch of any items that form a back order.
7) Internet only businesses will only be supplied after careful consideration at Head Office. The minimum order value for these accounts is £1500.
8) Customers shall not list, sell or offer Bigjigs Toys products and products bought from Bigjigs Toys for sale on any third party website or auction site for example and not limited to Amazon, eBay, Etsy etc. Customers shall not sell any such products on to any third party which intends to or then lists, sells or offers the products for sale in this way. As of 1st june 2013 we will no longer supply any trading account that offers or has the intention of offering Bigjigs Toys products for sale on any third party website or which sells the products on to a third party which then offers the products for sale in this way. Customer accounts listing products bought from Bigjigs Toys on third party websites will be closed. The purchasing of products from Bigjigs Toys and the listing on a third party website, in the UK or abroad, under an alternative trading name is also prohibited.
9) Payment is to be received by us within 28 days of invoice date unless alternative terms have been agreed between both parties and if applicable. If payment is received by us within 10 days, a 3% early settlement discount may be deducted from the invoice. The 3% early settlement discount may only be taken if there are no older outstanding invoices. The amount to be deducted will be shown at the bottom of the invoice and applies to payments by cheque or BACS only. Should payments arrive after the 10 day period and the discounts have been deducted by the customer these will remain outstanding on the respective account. For payments by cheque, please return your payment to us enclosing your account details and invoice numbers. BACS is the preferred method of payment, please ensure both your trading name and postcode are set as a reference when making a payment direct to our account. Settlement discounts are not applied to pro-forma invoices.
10) For payments by credit or debit card, discounts are not available. A charge for payments by card will not be made by us. However, we reserve the right to charge a 2.5% surcharge should your credit card be registered outside the UK. 11) Should an account remain outstanding for 30 days after the due date, the account will be passed to our debt collecting solicitors. At the point of submitting your details to our debt collecting solicitors a £50 + VAT admin fee will be applied to your account and any pending orders will be cancelled.
12) All goods remain the property of Bigjigs Toys Ltd until payment has been received by us. The risk in the goods shall pass from the seller (Bigjigs Toys Ltd) to the buyer upon such delivery to the buyer. However, notwithstanding delivery and the passing of risk in the goods, title and property in the goods, including full legal and beneficial ownership, shall not pass to the buyer until the seller has received in cash or cleared funds payment in full for all goods delivered to the buyer under all contracts between the seller and the buyer. Payment of the full price of the goods shall include the amount of any interest or other sum payable under the terms of any contract between the seller and the buyer under which the goods were delivered.
13) UKCA and CE labelling and our Company details - As of July 2011 it is a legal requirement of the Toy Directive that all toys sold in the EU bear the Manufacturers and/or the Importers details. Please ensure that all products supplied to you from Bigjigs Toys Ltd remain in their original packaging at the point of sale.
14) Any complaints relating to the goods or the invoice must be notified to Bigjigs Toys Ltd by the customer within 5 working days of receipt. Goods must only be returned after prior consultation and if you have been asked to do so. The completion of a Goods Return Form is mandatory. A copy of this is available from our website or by email. Without the completion of a Goods Return Form any returns cannot be credited. Re-stocking charges are 10% of goods value or £50, whichever is greater.
15) Unless otherwise agreed in writing, the terms and conditions of this agreement shall apply to any order placed by the customer. In the event of any inconsistency between the terms and those passing between the parties these terms shall prevail. No variation of the terms and conditions shall be allowed unless expressly accepted in writing.
16) We reserve the right to update our terms and conditions without notice.
